Fair Deal Loan Scheme

In certain circumstances

in order to contract for care services, for the Nursing HomeSupport Scheme (the Fair Deal) or to make other arrangements, if the person’s capacity is in question, the hospital, care home or HSE may require that a decision supporter, often a Decision-Making Representative (DMR) enter into those contracts as DMR for them, and deal with their finances, bank accounts, banks and other relevant third parties on their behalf. 

To become Decision-Making Representative (DMR) for another person requires an application to the Circuit Court.

We have acted for families to bring such applications before the Circuit Court, including preparing the necessary paperwork, moving the application and advising in relation to the orders obtained. 

It is also important to assess whether such an application is in fact required, or whether a lesser intervention on behalf of the person would be sufficient.
