Application to become Decision-Making Representative
You may find that a family member needs your support to make decisions regarding accommodation, education, healthcare or finances and that they lack the capacity to make that decision.
In certain circumstances, in order to contract for care services, for the Nursing Home Support Scheme (the Fair Deal) or to make other arrangements, if the person’s capacity is in question, the HSE may require that a decision supporter, often a Decision-Making Representative (DMR) enter into those contracts as DMR for them, and deal with their finances, bank accounts, banks and other relevant third parties on their behalf.
To become Decision-Making Representative (DMR) for another person requires an application to the Circuit Court.
We have acted for families to bring such applications before the Circuit Court, including preparing the necessary paperwork, moving the application and advising in relation to the orders obtained.
We have also acted for the person themselves to represent them and their interests in such applications.
